As many of you may know, a major tax reform bill, referred to as the “One Big Beautiful Bill”, was recently passed by the U.S. House of Representatives and is now under review by the Senate. While the bill is still making its way through legislative procedures, it contains a number of provisions that could directly affect the way global organizations manage information reporting, tax withholding, and international compliance.
At Comply Exchange, we’re keeping a close watch on these developments and preparing internally to support any required changes in your workflows. Here’s what you need to know.
1. Increased Reporting Thresholds
- Form 1099-NEC/MISC: The bill proposes raising the reporting threshold for independent contractor payments from $600 to $2,000, with the goal of easing the burden on small businesses and lowering administrative overhead for lower-value payments.
- Form 1099-K: For third-party settlement organizations (e.g., PayPal, Venmo), the reporting threshold would revert to $20,000 and 200 transactions, reversing the lower $600 threshold imposed in 2022.
2. Withholding Rate Increases for Certain Countries
- A standout provision introduces a new regime that targets jurisdictions with “unfair or discriminatory tax rules” against U.S. entities. Countries designated as discriminatory could face an increase in withholding rates on U.S.-source income starting at 5% in Year 1, with potential increases up to 20%. Note, this is on top of the current statutory rates that already apply.
- This provision could significantly impact documentation collection and rate application for payees that are located in impacted countries.
These proposals, while not yet finalized, signal a shifting regulatory landscape that could introduce added complexity to an already burdensome compliance process. Whether you’re collecting tax forms, managing withholding rates, or trying to comply with year-end reporting requirements, agility and automation are going to be key.
Our team is already working behind the scenes to ensure we’re ready to respond swiftly and efficiently should the bill pass. Specifically:
- We’re reviewing all withholding logic and documentation rule sets to prepare for any country-specific rate adjustments.
- We’re looking at enhancing monitoring capabilities to flag countries that may be designated as discriminatory.
- We’re looking at added features to flag impacted payees based on evolving jurisdictional status, helping you stay ahead of compliance without manual intervention.
Put simply, we’re building the flexibility now, so you’re not caught off guard later.
We’re here to help you navigate these changes with clarity and confidence. As the legislation moves forward, we will continue to keep you updated. In the meantime, if you have questions or would like to discuss how these developments may affect your operations, we’re just a call or email away.
Thank you for your continued trust in Comply Exchange.
